3. Services Retro Tow Limited provides WordPress support and development services as outlined in individual service agreements or support tickets. All services are delivered digitally. Specific deliverables, timelines and payment terms are agreed upon at the commencement of each engagement.
4. Intellectual Property All content on the Retro Tow Limited website — including text, graphics, logos and branding — is the intellectual property of Retro Tow Limited and is protected by applicable copyright and intellectual property laws.
Upon receipt of full payment, clients receive ownership of custom deliverables as specified in their service agreement. Retro Tow Limited retains ownership of all proprietary frameworks, tools and methodologies used in service delivery.
5. Client Responsibilities Clients are responsible for:
- Providing accurate and complete information relating to their WordPress environment
- Granting necessary access credentials in a timely manner
- Reviewing and approving deliverables within agreed timelines
- Ensuring all materials provided do not infringe on third-party intellectual property rights
6. Payments All prices are agreed upon at the time of service engagement. Payments are due as outlined in the agreed payment terms. Retro Tow Limited reserves the right to pause or suspend work on any engagement where payment obligations are not met.
7. Confidentiality Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the service engagement. This obligation survives the termination of any service agreement.
8. Limitation of Liability To the fullest extent permitted by applicable law, Retro Tow Limited shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from the use of our services, including but not limited to data loss, site downtime or third-party plugin failures.
9. Disclaimer of Warranties Retro Tow Limited provides its services on an “as is” basis. We do not warrant that our services will be error-free or uninterrupted, and we disclaim all warranties not expressly stated in a service agreement.
10. Governing Law These Terms and Conditions are governed by the laws of the jurisdiction in which the client is domiciled or as otherwise agreed between the parties in writing. Any disputes shall be resolved through good-faith negotiation before any formal legal proceedings are initiated.
